Risk & Investment Disclaimer

Read this before using MEDGE Capital.

MEDGE Capital is an analytics tool. It is not a regulated financial advisor, broker, fund manager, or investment firm. Nothing on this Platform is a recommendation to buy, sell, hold, or otherwise transact in any security or financial instrument. You alone are responsible for any decision you take based on what you see here.

1. Not investment advice

All information, analytics, simulations, optimisations, backtests, AI-generated narratives, news summaries, watchlists, calendars, dashboards and any other output produced by the Platform are provided for educational and analytical purposes only. They do not constitute, and must not be construed as:

  • ·investment advice within the meaning of MiFID II (Directive 2014/65/EU) or any equivalent regime;
  • ·a personal recommendation, solicitation or offer to buy, sell, subscribe to, redeem, or hold any security, derivative, fund, currency, cryptocurrency, commodity or other financial instrument;
  • ·tax, legal, accounting or actuarial advice;
  • ·a guarantee of any specific outcome, performance, return or risk profile.

Before making any investment decision, you should consult a qualified, independent and duly authorised financial advisor in your country of residence, and should make your own assessment of whether the investment is appropriate for your personal circumstances, objectives, financial situation and risk tolerance.

2. Regulatory status

The Provider — Giuseppe Lamberti — is not authorised by any financial regulator. Specifically, the Provider is not registered with, supervised by, or affiliated with:

  • ·CONSOB (Commissione Nazionale per le Società e la Borsa, Italy);
  • ·Banca d’Italia;
  • ·FCA (Financial Conduct Authority, United Kingdom);
  • ·BaFin (Bundesanstalt für Finanzdienstleistungsaufsicht, Germany);
  • ·AMF (Autorité des Marchés Financiers, France);
  • ·SEC, FINRA or CFTC (United States);
  • ·or any other competent authority in any other jurisdiction.

MEDGE Capital is not a SIM (società di intermediazione mobiliare), SGR (società di gestione del risparmio), bank, payment institution, electronic money institution, insurance undertaking, or any other regulated financial entity. The Service is not a “servizio di investimento” within the meaning of the Italian Testo Unico della Finanza (D.Lgs. 58/1998).

3. Past performance and forward-looking output

Historical results, simulated trades, optimisation outputs, backtests, Monte Carlo projections, factor attributions and any other backward-looking metric on the Platform are not indicative of future performance. Backtests in particular:

  • ·are computed on data revisions available at the moment of computation, which may differ from the data available in real time at the historical date;
  • ·do not include real-world frictions such as bid-ask spreads, slippage, market impact, borrow costs, short-sale unavailability, dividend tax withholding nuances, partial fills, or trading halts unless explicitly modelled;
  • ·typically assume continuous rebalancing or perfect execution at the close, which is not achievable in real markets;
  • ·are sensitive to data-mining bias and survivorship bias on the universes selected.

AI-generated narratives are produced by large language models on the basis of the structured data available at the time of generation. They may contain inaccuracies, hallucinations or subjective interpretations. Treat them as a starting point for further verification, never as ground truth.

4. Capital at risk

Investing in financial markets carries the risk of partial or total loss of capital. Specific risks include but are not limited to: market risk, credit risk, liquidity risk, counterparty risk, currency risk, interest-rate risk, leverage risk, derivatives risk, concentration risk, geopolitical risk, model risk, operational risk, and tax-treatment risk. Some instruments may produce losses exceeding the amount initially invested (e.g. leveraged or margined positions).

You should never invest funds you cannot afford to lose, and you should always consider whether a given product is appropriate for your level of experience, financial means and objectives.

5. Data sources and accuracy

The Platform aggregates and presents data sourced from third-party providers and public datasets, including but not limited to:

  • ·MarketStack and MediaStack (price quotes, news);
  • ·FRED (Federal Reserve Economic Data, St. Louis Fed);
  • ·SEC EDGAR (13F, 13D/G filings);
  • ·FCA Special Position Reports (UK short positions);
  • ·CFTC (Commitments of Traders);
  • ·BIS, IMF, World Bank, OECD, Eurostat, ECB SHS;
  • ·OpenAI (large language model outputs).

The Provider uses commercially reasonable efforts to integrate these sources accurately, but does not warrant their completeness, timeliness or accuracy. Data may be delayed, incorrect, incomplete or revised after publication. Vendor outages, parsing errors, schema changes, rate limits or regulatory blackouts may cause gaps. Do not assume real-time accuracy unless explicitly stated for a specific data feed.

6. Geographical restrictions

The Platform is operated from the European Union and is principally intended for users resident in the European Economic Area, the United Kingdom and Switzerland. The Provider makes no representation that the Platform or its content is appropriate for use, or available, in any specific jurisdiction. You are responsible for ensuring that your use of the Platform complies with the laws of your country of residence.

In particular, residents of jurisdictions where the marketing or distribution of unregulated financial-information services is restricted (including, where applicable, the United States, Canada and Japan) should not access or use the Platform unless they are satisfied that doing so does not breach local regulation.

7. No fiduciary relationship

Use of the Platform does not create any fiduciary, advisory, custodial, agency, partnership or joint-venture relationship between you and the Provider. The Provider does not custody your assets, does not have access to your brokerage accounts (unless you explicitly connect a read-only feed), does not execute trades on your behalf, and does not take discretionary investment decisions for you.

8. Forward-looking statements

Statements that are not statements of historical fact — including any projection, forecast, price target, allocation recommendation, scenario or expected return — are forward-looking statements. Forward-looking statements are inherently uncertain and may differ materially from actual outcomes due to a wide range of factors, many of which are outside the Provider’s control. The Provider undertakes no obligation to update any forward-looking statement after the date of publication.

9. Limitation of liability

To the maximum extent permitted by applicable law, the Provider shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including loss of profits, loss of investment opportunity, loss of capital, loss of data, or business interruption, arising from or related to your use of (or inability to use) the Platform, or from reliance on any output produced by the Platform.

Nothing in this disclaimer excludes or limits liability that cannot be excluded under applicable mandatory law (including, in particular, liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by negligence). The full liability framework — including the 12-month aggregate cap and the country-specific carve-outs for UK, German and French consumers — is set out in Section 13 of the Terms of Service.

10. Updates to this Disclaimer

The Provider may update this Disclaimer from time to time to reflect changes in regulation, business practice or service features. Material updates will be notified by email at least 30 days before they take effect. Continued use of the Platform after the effective date constitutes acknowledgement of the updated Disclaimer.
